Terms & Conditions

1. General

These General Terms and Conditions (Algemene Voorwaarden) apply to all legal relationships between Katashov Tax, registered with the Dutch Chamber of Commerce (KvK) under number 98322206, with offices at Nieuwpoortstraat 94B1, 1055RZ, Amsterdam (the "Service Provider"), and the Client.

By placing an order or signing an agreement with Katashov Tax, the Client confirms having read and accepted these General Terms and Conditions.

2. Formation of the agreement

The agreement is established when the Client accepts a proposal (offerte) from the Service Provider, accompanied by these General Terms and Conditions. All proposals are irrevocable unless explicitly stated otherwise.

The agreement is entered into for an indefinite period unless otherwise specified in the proposal.

3. Client obligations

The Client must provide all necessary documents, data, and information for the execution of the assignment in a timely manner. The information must be complete, accurate, and up to date.

The Client shall immediately inform the Service Provider of any changes that may affect the execution of the assignment.

Any additional costs and consequences arising from the Client's failure to provide information in a timely or complete manner (including Belastingdienst penalties) shall be borne by the Client.

4. Performance of services

The Service Provider shall perform services diligently, with due care, and in accordance with the requirements of good professional practice. The Service Provider's obligations are best-efforts obligations (inspanningsverplichting), not obligations to achieve a specific result.

The Service Provider may engage third parties in the performance of the assignment.

5. Deadlines

For VAT return assignments, the Client must provide all documents for the reporting quarter no later than 10 days after its end.

For income tax return assignments, the Client must provide all documents within 14 days of concluding the agreement. The Service Provider will file the return within 14 days of receiving the complete set of documents.

6. Fees and payment

All rates are exclusive of VAT (BTW) unless otherwise stated.

Payment is due within 14 days of the invoice date. Objections to the invoice amount do not suspend the payment obligation.

In case of late payment, the Service Provider may suspend services and charge collection costs.

7. Confidentiality

The Service Provider is obliged to maintain confidentiality regarding all information received from the Client, except where disclosure is required by law or necessary for the execution of the assignment (e.g., filing declarations with the Belastingdienst).

8. Liability

The Service Provider's liability for damages in connection with the performance of an assignment is limited to the amount paid out under the Service Provider's professional liability insurance policy.

If no insurance payout is made, liability is limited to the fees received for the relevant assignment.

The Service Provider is not liable for indirect or consequential damages, lost profits, penalties, or consequences arising from incomplete or inaccurate information provided by the Client.

9. Termination

Either party may terminate the agreement at any time with one calendar month's notice. Termination does not release either party from obligations arising before the termination date.

10. Complaints

Complaints regarding work performed or invoice amounts must be submitted to info@katashovtax.nl within 30 days of the service delivery or invoice date.

11. Applicable law

These General Terms and Conditions and all legal relationships between the Service Provider and the Client are governed by Dutch law. Disputes shall be resolved by the competent court in Amsterdam.
